NEGLIGENT SECURITY

A cyclist struck by a car has no bumper, no crumple zone, and no airbag, so a collision that would leave two drivers exchanging paperwork leaves a rider with fractures, a head injury, or worse. Riders also start out blamed more often than any other kind of client we represent. New York City and the dense New Jersey corridors now carry heavy bicycle, e-bike, and delivery traffic on streets that were never built for it.

Cases we handle:

  • Dooring collisions, where a driver or passenger opens a door into a rider’s path.
  • Right-hook and left-cross collisions at intersections, driveways, and garage entrances.
  • Unsafe and close passing, including deliberate buzzing.
  • Trucks and buses making wide right turns across a bike lane.
  • Collisions with vehicles standing, double-parked, or loading in a bike lane.
  • Bike lanes that end abruptly, are poorly marked, or channel riders into conflict points.
  • Roadway defects, including potholes, sunken trench restorations, expansion joints, and drainage grates.
  • Hit-and-run collisions and crashes involving uninsured drivers.
  • Collisions involving e-bikes, mopeds, and commercial delivery riders.
  • Bike-share injuries, including defective equipment.
  • Component failures, including fork, frame, brake, and quick-release failures.
  • Dogs running loose into the roadway.
  • Collisions on bridges, greenways, and shared-use paths.
  • Fatal bicycle collisions.

We preserve the bicycle before anyone repairs it.

The bike is often the best witness in the case. Frame deformation, wheel damage, and drivetrain damage establish the direction and force of impact, so we photograph and store it rather than letting it go to a shop or a dumpster. The same goes for the helmet, the torn clothing, and the shoes. We document where debris, glass, and fluid ended up on the roadway, because that lets a reconstruction expert place the actual point of contact when the driver’s account of where you were riding does not match the physical facts.

We look for video the police never collect.

A responding officer writes a short report and leaves. Storefronts, apartment buildings, garages, buses, and nearby vehicles frequently captured the collision, and almost none of it survives unless someone asks within days. We canvass the corridor immediately, send preservation letters, and follow with formal requests for signal timing, roadway design, maintenance history, and prior complaints about the same location. In delivery rider cases we also pursue the platform’s dispatch and route records.

We sort out who pays for treatment.

Riders routinely assume that because they were not driving, no automobile insurance applies to them. The opposite is usually true, and medical benefits are frequently available even though you were on a bicycle. Where the driver fled or had no coverage, other sources may still exist. We identify what applies and in what order before bills start going unpaid, because getting that wrong early creates collection problems that follow a client for years.

We prepare for the blame from the first day.

Expect to hear that you wore no helmet, ran the light, rode against traffic, had no lights, or were outside the bike lane. We answer each with the physical evidence, the footage, and the road conditions that made a particular lane position necessary. Left unanswered, these arguments become the entire discussion of your case, which is exactly the intent behind them.

The window on the evidence is days.

Businesses along the route overwrite their footage, the pothole gets paved, and the striking vehicle gets repaired and sold. A rider who waits a month often finds the proof of what happened is simply gone.
