Pedestrian Accident

A pedestrian struck by a vehicle absorbs the entire force of the impact with nothing in between, which is why these collisions produce serious fractures, head injuries, and deaths out of all proportion to how minor the contact seemed to the driver.  What usually determines the outcome is how quickly the crossing, the signal, the sight lines, and the driver’s speed get documented, because all of that changes within weeks of the crash.

We document the crossing before it changes

The intersection itself is evidence.  Signal timing, the length of the walk phase, the condition of the crosswalk markings, obstructions from parked trucks or scaffolding, and the placement of signage all bear on whether the driver should have seen you.  Municipalities repaint markings, retime signals, and clear obstructions, so we photograph and measure the scene early and request the timing and design records directly.

We find the video, because there almost always is some.

Busy crossings are heavily surveilled by businesses, residential buildings, buses, and other vehicles, and almost none of that footage is gathered by the responding officer.  It is also overwritten quickly.  We canvass the surrounding block immediately and send preservation letters, because a few seconds showing the walk signal or the driver’s approach speed turns a disputed case into a clear one.

We handle the medical coverage most pedestrians do not know exists.

People struck while walking assume that owning no car means no automobile insurance can help them.  That is frequently wrong, and there are often sources available to pay treatment while the case proceeds, including in cases where the driver fled or had no insurance.  We identify the right source in the right order early, because unpaid bills go to collection while the investigation is still underway.

We prepare for the blame shifting.

The response in these cases is that you stepped out, crossed against the signal, walked between parked cars, wore dark clothing, or were looking at your phone.  We meet each with the footage, the physical evidence, the location of the damage on the vehicle, and the driver’s own account of when they first saw you, which often shows they were not watching the road.  Where a seriously injured client cannot remember the collision, this development is the entire case.
